TERMS AND CONDITIONS
Please read these Terms before using the Checkout and placing an Order through the Checkout. Please print or save these Terms for future use as we will not keep a file copy specifically for the transaction with you and we cannot guarantee that they will remain accessible on our website in future.
1.1 To place an Order, you must be at least 18 years of age (or any age legally required under local law where you are resident to bind yourself legally to these terms). By doing so, you confirm to us that you meet this requirement.
2. ACCEPTANCE OF ORDERS
2.1 Once you have placed your Order, we will promptly acknowledge your Order by sending you an email which will contain the relevant details of your Order. We do not accept your Order (and therefore we make no commitment to provide you with the Merchandise), and no contract for the sale of such Merchandise shall come into effect, until we specifically accept your Order and notify you that we have dispatched the Merchandise to you ("Order Confirmation").
2.2 We make the appropriate efforts to process and fulfil any Order as quickly as possible. However, we may, upon notice to you, decline to accept your Order if: (a) the Merchandise is unavailable (in which case, if the payment was processed, we will refund you in accordance with these Terms); or (b) we are unable to verify the payment information you provided.
2.3 We reserve the right to decline your order without explanation if we have cause to believe that you might pose a threat to public safety or security in Vietnam.
2.4 We may, if we suspect someone's identity, address, email address and/or payment information is being used fraudulently or in an unauthorized manner, also require additional verifications or information before accepting any Order.
3. FULFILMENT, HANDLING AND DELIVERY OF ORDERS
3.1 You acknowledge and agree that we or one of our third-party fulfilment services providers acting on our behalf, may handle the delivery and fulfilment of your Order.
3.2. Not all Merchandise can be delivered anywhere (due to limitations imposed on the Merchandise or by the destination) but the Checkout will not permit you to submit your Order if the Merchandise cannot be delivered to your specified address.
3.3 Delivery will be complete when we deliver to the address which you specify when ordering (that may include the port of entrance to the destination as specified on the Checkout, in case you have selected not to pre-pay customs duties).
3.4 For certain delivery destinations and/or Merchandise, you are responsible for applicable Customs Duties, Import Charges of your Order or any other fees as the Merchandise arrives in the country of your original delivery address.
3.5 We may deliver different parts of your order on different dates. Unless otherwise stated, and subject to applicable laws, delivery dates given on Checkout (or on the webstore) are estimates only. Your order will be fulfilled by the delivery date set out in the Order Confirmation or, if no delivery date is specified, then within 30 days after the date of the Order Confirmation, unless there are exceptional circumstances. Delivery timeframes are affected by your delivery address and the delivery method selected. We are unable to specify an exact delivery date and time.
3.6 We have no liability for any losses arising from delay in delivery to the extent that this is due to circumstances beyond our reasonable control and where we could not have taken reasonable steps to deal with the delay. For example, delays resulting from customs clearance procedures or other actions of relevant authorities are generally outside our control, or delays resulting directly from your actions or omissions.
3.7 If you receive notification of an unsuccessful attempted delivery, it is your responsibility to use the details provided to contact the delivery company to arrange re-delivery. If you have selected a delivery method that does not require a delivery to be signed for and nobody is available to receive the Merchandise, we reserve the right to leave them at the doorstep, hall or reception as available.
3.8 There is no charge for delays in arrival and departure because of weather conditions disrupting flights or roadblocks. The tourist must however bear the amendment fee if required.
3.9 For local customers with delivery in Vietnam, your items will be delivered via Postal Service according the Contact information that you registered when making the purchase. It is advised that customer will immediately contact our Customer Support if merchandise have not arrived within delivery estimate or visit our website for assistance
4. RATES AND PRICE VARIATIONS
4.1 Exchange rates may be set and updated regularly, and you acknowledge that such updates may affect Merchandise pricing on the Checkout. You will be charged according to the applicable exchange rate at the time you actually make your Order via the Checkout as displayed on the Checkout.
4.2 We reserve the right to vary prices and rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you are required to pay the increase when notified by us or you may cancel the booking which may result in cancellation fees. We are not liable in any way if any increase occurs. Rates quoted are appropriate to the particular product at the time of quoting and these rates may change prior to the travel date. All prices are subject to availability and can be withdrawn or varied without notice.
5. ORDER CONFIRMATION
All products will be shipped within 10-15 days after order is confirmed via email. If there are any changes, you will be noticed via email.
6. ORDER CANCELLATION/ REFUND POLICIES
The Returns Policy applies to all customers.
6.1 Cancellation by Customers
6.1.a Cancellation and refund are unavailable after order is confirmed.
6.1.b Garments sold are non-refundable and non-exchangeable.
6.2 Cancellation by Us
6.2.a In the unlikely event that such circumstances should arise we will contact you immediately and offer you the choice of an alternative of equivalent quality or a full refund of all money paid. No additional compensation will be paid over and above the total sum received from you.
7. EXCHANGE POLICY
7.1 Product may only be exchanged for manufacturing errors
7.2 The product can only be exchanged when the customer informs our Customer Service within 3 days of receiving the goods
8. OWNERSHIP AND RISK IN MERCHANDISE; IMPORTER OF RECORD
8.1 We pass the ownership of the Merchandise ordered to you the moment we dispatch the Merchandise to you (provided you have made full payment of the Merchandise price plus delivery charges and any other charges payable under these Terms, as applicable).
8.2 Risk of damage or loss to the Merchandise passes to you on delivery to you or to somebody identified by you to carry or take possession of the Merchandise on your behalf.
